The changes to the PMPRB guidelines may not go into effect January 2019 as first announced.
In their May 2018 newsletter, the PMPRB introduced its next steps towards the implementation of the amended “Regulations” with their revised PMPRB Guidelines. The PMPRB guidance document that will provide details on operationalizing the regulatory changes will not be released now until June 2018. At that time, a multi-stakeholder “Working Group” will gather input on the “key technical aspects of the new regime”. The Working Group will not present their findings to the Board until the fall of 2018. There will then likely be another period of consultation later in the fall.
The PMPRB will only finalize its Guidelines after the final publication of the “Regulations”, Canada Gazette, Part III, which enforce them as an Act of Parliament. Given their new timelines, it is still possible for the final Guidelines to be in place by the January 2019, but it would not be easy because the final consultation period may not even get started until late fall 2018.
