Pangaea Express: PMPRB Proposed Practice Directions - Revised

The PMPRB has provided a revised Patented Medicine Prices Review Board (PMPRB) Proposed Practice Directions based on feedback from stakeholders during the spring 60-day consultation period. The Board has provided draft Notices of Motion regarding how and when motions will be commenced, the content of motion records, and filing requirements as well as draft Confidentiality Orders given the frequency of confidentiality issues in PMPRB proceedings.

Revisions also include:

  • Paper and virtual proceedings are preferred but not the default – mode used will be determined on case-by-case basis
  • Time-frames have been expanded (hearing process, response to a motion)
  • Length of written submissions (page limits) extended
  • Greater clarity on AI disclosure requirements (a Declaration in the first paragraph of any document which utilizes AI stating that AI was used to prepare the document and specifying which sections of the document were generated using AI technology)

These Practice Directions are intended to improve the efficiency, consistency, and fairness of PMPRB hearings. Comments on the revised proposal is open for 30 days (written submissions due September 24, 2026) and will be considered prior to the final the Practice Directions.
